TERMS OF USE Sound.org Inc. This website has been designed to introduce viewers to the on-line library of impulse response files of Sound.org Inc. (“Sound.org”) a company that distributes new and innovative audio related materials. For more information on Sound.org, please click here. Upon your agreement to the terms and conditions herein, and at Sound.org’s sole discretion, you may submit your IR file to be uploaded to the Sound.org website, for downloading and use by its viewers. Waves reserve the right to select which IR's to post on acoustics.net. Not all submissions can be posted. You are only authorized to make use of the Sound.org website if you agree to abide by all applicable laws and the following terms and conditions, which shall constitute an agreement between you and Sound.org regarding your uploading to this website. Please read these Terms of Use carefully. If you do not agree with them, you should leave this site immediately. Any questions, comments or problems regarding this web site should be sent to the site administrator at webmaster@sound.org.
1.	In uploading your IR file to the Sound.org website (the “Uploaded File”), you agree and acknowledge that you relinquish all of your rights to the Uploaded File, and that Sound.org viewers may download the Uploaded File, for their non-commercial use, in perpetuity. You further represent and warrant that (a) that you can grant the rights to the Uploaded File which are granted hereunder, that the Uploaded File is original and has not been previously published; (b) that you are the author of the Uploaded File and the owner of the copyright herein, and that said rights are not and will not be subject to any agreement, lien or other right which may interfere with the rights of Sound.org to upload the Uploaded File and to grant use of the Uploaded File to its viewers; (c) that the Uploaded File is such that valid copyright may be secured in it and that such copyright will continue in effect during the time in which the Uploaded File is on the website; (d) that the Uploaded File does not and will not contain any libelous, obscene or other unlawful matter; (e) that the Uploaded File does not and will not in any way infringe upon the copyright of or violate the rights of privacy, the right of publicity or any other right of, any person or party; (f) that the Uploaded File does not and will not contain any recipe, formula, instruction, virus or other matter that may cause injury or damage to its readers or others, or their computers.
2.	You will not use the website in any manner that is unlawful or harms Sound.org or its distributors and/or suppliers. You may not use this website in any manner that could damage, disable, overburden or impair the website, or interfere with any other party’s use of the website. You will not use the website to transmit, either directly or indirectly, any unsolicited bulk email or unsolicited commercial email.
3.	LIMITATION OF LIABILITY: IN NO EVENT IS SOUND.ORG LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES ARISING OUT OF, RESULTING FROM OR BASED ON THE UPLOADING OF THE IR FILE ONTO THE WEBSITE OR FROM ANY OF YOUR OTHER USE OF THE WEBSITE (INSOFAR AS THE SAME SHALL EXIST), EVEN IF SOUND.ORG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE EXCLUSION OF DAMAGES UNDER THIS SECTION IS INDEPENDENT OF YOUR EXCLUSIVE REMEDY AND SURVIVES IN THE EVENT SUCH REMEDY FAILS OF ITS ESSENTIAL PURPOSE OR IS OTHERWISE DEEMED UNENFORCEABLE. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) NEGLIGENCE, OR (4) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW.
4.	You agree to hold harmless and indemnify Sound.org from any direct or indirect loss or damages resulting from the Uploaded File, or from any inaccurate or incomplete misrepresentation or warranty provided to Sound.org from you.
5.	Sound.org may modify the terms, conditions and notices under which it offers the use of this website and you are responsible for regularly reviewing these and any additional terms posted on the website. Your continued use of the website constitutes your acceptance and agreement to such changes. Without derogating from the above, Sound.org may terminate this Agreement, and/or remove the Uploaded File from the website (or indeed, refuse to upload the Uploaded File at all), with or without cause, and with or without notice.
6.	This Agreement shall operate to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision shall be deemed severed, and shall not affect the validity or enforceability of any remaining provisions.
7.	This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law. You agree to submit any disputes hereunder to the exclusive jurisdiction of the competent court of New York, and you further irrevocably waive any right you may have to trial by jury in such dispute.
8.	These Terms of Use constitute the entire agreement between you and Sound.org relating to use of this website, and may not be assigned by you to any third party.
